Trade Mark Dispute: LAMBRETTA

Background

The LAMBRETTA scooter is a modern icon – forget Vespas!

Dormant as a brand for so long, the Lambretta Consortium planned for years to relaunch it with an updated scooter which maintains the heritage of the scooter. There was, however, a wrinkle in the plan. In the 70s, the old Lambretta business was struggling financially and sold certain assets to the Indian government. The true nature of the sale has remained unclear, but the Indian government asserted that this included the rights to the LAMBRETTA brand. As a result they had developed their portfolio by registering a large number of trade marks.

The Brief

The Lambretta Consortium had themselves also acquired a portfolio of trade marks in the LAMBRETTA brand, and so a dispute arose as to which company (or group of companies) would own the full rights to the mark.

The Result

In both the UK and the EU, Aaron Wood has been acting for a number of years for the Lambretta Consortium. After a number of successful cases, the rights of the Indian government have now been removed in most cases.
